Family Injured In Connecticut Car Accident Retains Sabatini & Associates

A Connecticut family seriously injured in a recent car accident has retained the law firm of Sabatini and Associates to represent them in their case.  The family was rear ended causing multiple family members including two small children to be injured. The entire family was taken from the collision scene by ambulance to the local emergency room. Our firm’s initial investigation into the collision has determined that the impact of the collision was greater than what the visible property damage to the vehicles would suggest. This was determined by witness accounts of the collision and structural damage to the family’s vehicle behind the bumper cover.

Second DePuy Hip MDL Is Formed

In August 2010, the DePuy ASR metal-on-metal artificial hip device was recalled due to an increased rate of revisions (follow up surgeries) occurring shortly after the original hip implant.  Certain medical literature and data has shown that a number of revisions in users of the ASR hip are due to metal debris from the metal components in the device.  Following the ASR recall, a MDL was formed for all lawsuits filed in federal courts around the nation.

Now a second MDL has formed because DePuy makes various hip devices besides the ASR.  Specifically, DePuy makes the Pinnacle metal-on-metal hip model that is similar to the ASR.  There have been reports of metal poisoning and pre-mature revisions occurring with the Pinnacle device.  Multiple lawsuits have been filed and the DePuy Pinnacle MDL has been assigned to Judge James E. Kinkeade in the Northern District of Texas.

$450,000.00 Mild TBI Settlement

Attorney James Sabatini has secured a $450,000.00 settlement for his client who suffered a mild traumatic brain injury.  The settlement was obtained despite having multiple doctors hired by the defendant express the opinion that the client did not have a permanent injury as a result of the head trauma.  The opinion was countered by the medical evidence that was obtained on the day of the trauma and during the weeks following the trauma. The medical documentation was consistent with trauma to the head and brain.  Consequently, there was no dispute that a brain injury was sustained.

This case is another example of the importance on getting medical attention and examination immediately following head trauma.  If it is not done, the medical evidence will be lacking thereby allowing the insurance company’s doctor to not only argue that there is no permanent injury but also argue that the accident in question never caused head trauma.
